SUMMARY TERMS AND CONDITIONS/PASSENGER FORM

Island Escape Cruises Limited and/or Island Escape Cruises (Vanuatu) Limited

Unless otherwise expressly agreed in writing, all cruises are sold upon the following terms and conditions to the exclusion of any terms and conditions of the purchaser and no agent or representative has any authority to vary or omit part of or all of these conditions. All bookings are subject to the full Terms and Conditions of the Island Escape Cruises Passage Terms and Conditions, a copy of which is available upon request, or by accessing our website www.islandescapecruises.com. Payment of your deposit is deemed as your acceptance of Island Escape Cruises terms and conditions.

PLACING A BOOKING

On making a booking, the option is valid for 7 days and will automatically expire after 7 days should a deposit not be received.

DEPOSIT AND FINAL PAYMENT

To secure your booking a non-refundable deposit of 25% is required. The deposit must be accompanied by a completed and signed Passenger Form and is due within 7 days of booking. Island Escape Cruises must receive final payment no later than 90 days before the sailing date. Please note that failure to make due payment in respect of bookings or installments shall entitle Island Escape Cruises to cancel a booking.

PASSENGER FORM

The completed and signed Passenger Form, attached below, must be submitted with your deposit. A copy of your current passport personal details page must be received with your Passenger Form if travelling internationally. Usually passports require 6 months validity.

CRUISE DOCUMENTS

Cruise Documents will be delivered to you approximately 30-45 days prior to the sailing date. Failure to send a Passenger Form or passport details (where applicable) will delay documentation. Cruise documents will include boarding card, cruise itinerary, onboard ship information, embarkation and disembarkation information.

Itineraries are subject to prevailing weather conditions and may be changed without notice.

PASSPORTS AND VISAS

Regulations do vary from country to country and by nationality, and are subject to change at short notice. If you are in transit or staying in the country of embarkation or disembarkation before or after your cruise, different visa rules may apply. We recommend that you check well before departure. Please note that if you do not hold a valid passport or visa (as regulations may require) for the countries you are visiting, you may be refused permission to land, or in extreme circumstances, travel from your home country. 

It is the sole responsibility of each passenger to comply with Visa and Passport regulations.

ADDITIONAL GUESTS

Some expedition cabins accommodate an additional passenger in a Pullman berth. Passengers aged 13 years and over pay 50% of the applicable expedition cabin fare when sharing the room with two full-fare passengers. Subject to availability and only on some expedition cabins.

SINGLE PASSENGER

Cabin accommodation is based on double occupancy. Sole occupancy can be requested on the basis of 1.5 times the published fare in a twin berth or 1.8 times in a double berth cabin.

CRUISE FARE – WHAT’S INCLUDED

Included in your cruise fare are accommodations as booked, cruise transportation, all meals onboard, non-alcoholic beverages, bottled water, coffee and tea, cocktail on boarding, use of kayaks, water sport equipment and facilities, port and handling charges, shore excursions and tender transfers, Government fees and taxes.

CRUISE FARE – WHAT’S NOT INCLUDED

Cruise fares do not include items of a personal nature. Any type of travel insurance (including but not limited to: medical, liability, loss of deposits, luggage and effects, personal accident) bar expenses, optional shore excursions and telephone charges.

ONBOARD EXPENSES

All onboard prices are quoted in New Zealand, Australian dollars and Vanuatu Vatu. You may charge onboard expenses to your shipboard account that is settled at the end of the cruise with a credit card. We accept American Express, Diners Club International, MasterCard and Visa. You may also use cash. There are no cash withdrawal facilities onboard and we are unable to accept personal cheques.

GRATUITIES

Gratuities are not expected, however if you wish to acknowledge exceptional service you are welcome to do so entirely at your discretion.

CANCELLATION FEES

The following cancellation fees will apply to all bookings. The day on which notice is received by Island Escape Cruises will determine the applicable penalties. Cancellation notices must be provided in writing.

90 days prior to sailing or less - 100% of fare

LIABILITY CONDITIONS & PHYSICAL CONSIDERATIONS

Island Escape Cruises is an adventure travel organization. In any adventure activity there is an element of risk involved. Risks in undertaking activities may include fishing, snorkeling and swimming together with helicopter flights, onshore and boat trips and usual maritime circumstances. The nature of cruises offered means that passengers may encounter physical discomfort and possibly even danger. This being the case, it is expected that every passenger 
understand and appreciate the risks involved and is prepared to accept those risks as part of the spirit of adventure. Island Escape Cruises undertakes to deliver services with all due care however it is intended that passengers accept ultimate responsibility for any damage to or loss of personal property, illness, injury or death. Any medical condition, advanced pregnancy or disability must be advised to Island Escape Cruises within the Passenger Form. Guests should be sure to bring onboard sufficient supplies of any prescription medication they may require. 

Additionally, Island Escape Cruises will use its best endeavours to deliver services at indicated times, however Island Escape Cruises shall not accept liability for any losses, costs or expenses suffered as a result of any delay in the delivery of services. Further, Island Escape Cruises cannot accept any liability for breach of contract arising from or caused by, directly or indirectly, force majeure, war, industrial dispute, mechanical failure, civil unrest, natural disaster, operational safety of the ship or extreme weather conditions. Island Escape Cruises strongly recommends that passengers arrange comprehensive and 
adequate travel and cancellation insurance cover.

ACCESSIBILITY

Access to the vessel is via a stepped gangway, entrances to the vessel have raised coamings and all cabins have a step from bedroom to bathroom. If you will require regular assistance or care or are a wheelchair user an able-bodied companion must accompany you. The Captain will always have the final decision whether to take a guest ashore by tender. If the Captain believes that it is beyond the guest’s capabilities, might affect the enjoyment or 
safety of fellow guests, and/or compromise the health and safety of crewmembers then transportation may be denied.

INSURANCE

Island Escape Cruises strongly recommend that all passengers arrange comprehensive travel insurance to cover such things, but not limited to, medical, liability, loss of deposits, luggage and effects, personal accident, cancellation of cruise sailing, medical and emergency, evacuation and repatriation, flight and hotel cancellation. Please ensure that your travel insurance policy is of high quality and issued at your country of origin. We also suggest that travel insurance is arranged at the time of booking your cruise and we recommend you seek expert advice in this matter.

ASSUMPTION AND ACKNOWLEDGEMENT OF RISK

I warrant that I will not use any equipment supplied by Island Escape Cruises unless I am already familiar with the operation of that equipment or unless I am satisfied that I have received adequate instruction in its use. I acknowledge that I engage in this cruise and ancillary activities at my own risk. Subject to any statutory warranties (which, as far as is possible at law are expressly excluded) I acknowledge that Island Escape Cruises and its employees shall not be liable for any injury, loss or damage caused to me or my property while I am on the cruise, however caused. I hereby submit to the exclusive jurisdiction of the New Zealand Courts in respect of any matter arising from these Terms and Conditions of Travel.

In signing this document, I/we acknowledge that I/we have read and understood all of the above Terms and Conditions and Passage Terms and Conditions.
